Codesp cancels competition that excluded blacks, mixed race people and people with disabilities

Codesp, after a meeting with the Federal Public Ministry, cancels the competition opened in 2017 after recognizing several irregularities.

The São Paulo State Dock Company (Codesp) has cancelled a competition held in 2017 for new positions at the state-owned company. The company acknowledged irregularities during the competition. The decision was reached after a meeting with representatives of the Federal Public Prosecutor's Office, which had already spoken out in court in favor of suspending the selection process in a public civil action.

Codesp stated that the registration fees paid by candidates will be refunded and any employment contracts that may have been signed with those approved in the competition will be cancelled.

Cancellation of the competition

The Federal Public Ministry said it has already sent a petition to the 1st Federal Court of Santos requesting that the cancellation of the contest be approved.

According to the Attorney General's Office, the selection process used illegal criteria for a committee verifying self-declared racial profiles, which led to the disqualification of quota candidates. At least 56 people were harmed.

Initially, Codesp denied the flaws in the competition and obtained a court decision to refer the case to the State Court, claiming the Union had no interest in the case. The case was forwarded to the Superior Court of Justice (STJ) after the Federal Public Prosecutor's Office appealed.

Only in May of last year, changes to the company's bylaws allowed the 1st Federal Court of Santos to finally recognize its jurisdiction to judge the case and continue the proceedings.

“The procedural acts, especially the decision-making ones, will be carried out by a completely incompetent court, making it inevitable that such acts will be declared null and void,” said prosecutor Ronaldo Bartolomazi, referring to possible state decisions to annul the competition.

The prosecutor also warned that sending the case files could generate irreversible consequences due to the conclusion of the competition and the imminent hiring of those approved.
